Terms and Conditions
Before we proceed with our Terms And Conditions we would like to say a few words about art prints.
For our limited edition reproductions, we exclusively use the entire Hahnemuehle FineArt Collection product line, both paper and canvas.
Mainly, the limited edition prints are custom-made on Hahnemühle Photo Rag®, 100% cotton paper. This paper was invented by Hahnemühle and is considered the benchmark among FineArt inkjet papers.
This ensures a minimum display life of 150 years under normal contains.
However, art prints are always affected by environmental influences; their appearance and color can change and fade. In order for you to continue enjoying our works of art, you should not expose prints partially or completely, to direct sunlight, hang them directly above heating appliances, or expose them to higher humidity levels than expected in a typical living room. They are not suitable for outdoor spaces, basements, bathrooms, or kitchens as well.

Our terms and conditions are designed to regulate the business relationship between you and us, and they are designed to be binding and fair. The basis for any order or contract will always be these General Terms and Conditions of VARBO SECURITIES LLC - VARTART | Bespoke Prints, and you confirm that you are familiar with them and agree to their application when placing an order with us. Section 1: Scope
The following General Terms and Conditions, in their current version at the time of the order, are the exclusive regulator of the business relationship between VARBO SECURITIES LLC, Prague (operating under the VARTART | Bespoke Prints brand, hereinafter "VARTART") and the customer. VARBO SECURITIES LLC does not accept any other terms proposed by the customer, unless such terms are agreed in writing by VARBO SECURITIES LLC itself.
Section 2: Conclusion of the contract
Displaying products in an online store is not a legally binding offer; it is only a non‑binding online catalog. The products that you have selected by clicking the "Add to Cart" button are summarized for you in the order overview at the end of the checkout process. Here you can view all the information entered during the order and, if necessary, correct it by clicking the "Edit" button. Clicking the "Buy Now" button means that you send the order details and make a mandatory statement to VARTART about your intention to purchase the products listed there (Offer). We automatically accept your offer from the moment we receive your order. Immediately after sending the order, you will receive an e-mail confirming the order and the contract, which will contain the details of your order again.
The text of your order is saved by us and, upon request, can be sent to you after the order is completed. For your safety, VARTART recommends printing out the order details and the General Terms and Conditions in force at the time of the order. The contractual language is English.
Please note that we only sell all products in small quantities.
Section 3: Waiver (Cancellation)
Please note that prints of artworks with individual presentation, are not eligible for cancellation/recall, as they are custom-made according to your individual requirements. Custom-made goods are not eligible for cancellation in accordance with § 1837 of the Czech Civil Code.

You have the right to cancel this agreement within 14 days without giving reasons.
The deadline for refusal is 14 days from:
a) The day on which you — or a third party named by you, who is not a delivery service — took possession of the goods, if you ordered one or more goods in one order, and the goods(s) were delivered in one batch
or
b) The day on which you — or a third party named by you, who is not a delivery service — took possession of the last item in the event that several items from the same order are shipped separately.
To exercise the right of withdrawal, you must inform us (VASEC LLC, Londynska 7, 12000 Prague, Czechia, Tel: +123456489, E‑MAIL) of your decision to withdraw from the contract through a clear written statement (for example, by letter or e-mail).
The deadline for refusal is considered fulfilled if your notification of the exercise of the right to refuse is sent within the established period of refusal.
Cancellation terms and procedure
If you cancel the purchase and sale agreement, we are obligated to refund all payments you have received, including shipping costs (with the exception of additional costs incurred from choosing a delivery other than the standard, more expensive one), on time ‑ no later than within 30 days from the date of our receipt of the waiver. A refund will be made to the original payment method, unless otherwise agreed. We may withhold refunds until we receive the returned items or until you provide proof of shipment, whichever occurs first. You must return the goods in their original packaging without delay. As a last resort, they must be sent no later than 30 days from the date when you notified us of the refusal. The deadline is met if the refund is sent within this 30‑day period.
You bear the direct costs of returning the order. Usually, items cannot be returned by regular mail. Please contact our support team for more information.
You are responsible for reducing the cost of the product only if, after checking its condition, properties and functionality, the decrease in price may be due to improper handling of the product.
Section 4: Delivery
Unless otherwise agreed, delivery is carried out from the warehouse to your address or to the delivery address specified by you. The delivery time is approximately 10 business days.
Section 5: Signed Circulation Certificate
For organizational reasons, VartArt may send the Print Run Certificate with the artist's signature and print run details to the customer separately, with a possible delay. In this case, the waiver period will begin to run only after receiving a signed Circulation Certificate. If you exercise the right of refusal, you must also immediately return the unused Circulation Certificate. The purchase price will not be refunded without obtaining a Circulation Certificate. The right to refuse is lost if the Circulation Certificate is used on a work of art, frame, lamination, or elsewhere.
Section 6: Prices, due date and calculations, delay
The prices shown in the online store are the final prices, including VAT. Shipping costs are not included in the price and are added on a case-by-case basis. Information about the shipping cost is provided in section 7 of these Terms and Conditions.
The purchase price is paid by credit card. Please note that direct debit from a bank account is only possible from a Czech bank account. You can pay via PayPal or by credit card Visa or Mastercard. We don accept American Express.
If there are insufficient funds in the customer's account or the customer cancels the bank debit without a valid reason, VartArt has the right to charge the customer an administrative fee of €5.00.
If you delay payment, VartArt reserves the right to charge consumers punitive interest in the amount of 5 percentage points above the base rate per year published by the European Central Bank, and companies — 9 percentage points above the corresponding base rate. In addition, VartArt may charge a flat fee of €2.50 for each reminder, with the exception of the first notification. If there is evidence that more significant expenses have been incurred due to the delay in payment, VartArt has the right to make appropriate claims.
In these cases, you have the right to prove that the actual expenses of VartArt were either not incurred or were less than the specified fixed amounts.
Section 7: Shipping Cost
For shipments within the EU, VartArt applies the following shipping rates, which include our specialized safe packaging and insurance:

When placing an order online, select the country of delivery; the correct shipping cost will be shown.
Orders with items of different sizes will be shipped at the rate of the largest image in the order. Books are sent for free. If VartArt divides the order into several shipments for logistical reasons, there will be no additional costs on your part.
Section 8: Offsetting, retention
You are eligible for a set-off only if your counterclaims are found to be legally justified or recognized by VartArt. You can also claim a set-off if you make claims for defects or counterclaims under the same purchase and sale agreement. In addition, you may apply the right of retention only to the extent that your counterclaim is based on the same contractual relationship.
Section 9: Conditional possession (retention of title)
The delivered goods remain the property of VartArt until full and final settlement.
Section 10: Liability
Within the scope of legal regulation, VartArt is liable for damages without limitation.:
a) In cases of death, bodily injury or injury to health, if they are caused by an intentional or negligent breach of obligations or otherwise caused by the intentional or negligent conduct of VartArt or its legal representatives or auxiliary persons;
b) In cases where the damage is the result of an intentional or grossly negligent breach of obligations on the part of the supplier or its legal representatives or auxiliary persons;
VartArt's liability is limited to compensation for foreseeable damages or losses typical of this contract caused by a minor violation of the material obligations of VartArt or its legal representatives or auxiliary persons. Material obligations are those obligations, the fulfillment of which is a condition for the proper execution of the contract and which the customer can count on.
The above provisions apply appropriately to the liability of VartArt for the reimbursement of unnecessary costs.
The responsibility under the Product Liability Act remains unchanged.
Section 11: Warranty
Unless otherwise provided, the legal rights under the guarantee apply.
The standard legal warranty period is two years. It starts flowing from the moment the goods are handed over. During this period, all defects subject to a legitimate warranty will be eliminated free of charge.
If you, as the customer, are a legal entity in accordance with Section 14 of the Czech Civil Code, your claims for defects depend on your fulfillment of legitimate verification and notification obligations (paragraphs 377, 381 of the Czech Commercial Code). If a defect is found during the inspection or subsequently, you must immediately inform us about it. "Immediately" in this case means within two weeks, and timely sending of the notification is considered compliance with the deadline. Regardless of this duty of inspection and notification, you must notify obvious defects (including incorrect or incomplete delivery) in writing within two weeks of delivery, and timely dispatch of the notification is considered compliance with the deadline. If you do not perform a proper inspection and/or inform us of the defect, our liability for the undetected defect is excluded.
Section 12: No transfer of rights
When you purchase a photo print, you acquire only the material ownership of the print. No other rights are transferred or implied. Any reproduction (copying), distribution, rental, public exhibition or other similar or digital use is prohibited unless permitted by law. However, you can resell the print.
Section 13: Collection, processing and use of personal data
All provisions regarding the protection of your data are set out in the VartArt Privacy Policy.
Section 14: Applicable law
Czech law applies, with the exception of the UN Convention on Contracts for the International Sale of Goods.
